Terms of Service

1. Acceptance of Terms

By creating an account or using OptionsDeck Terminal (the "Service"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Service. OptionsDeck may modify these Terms at any time; continued use of the Service after changes constitutes acceptance of the updated Terms.

2. Eligibility

You must be at least 18 years old and legally capable of entering into a binding contract. You must not be located in a jurisdiction where using OptionsDeck would violate applicable law. OptionsDeck is not intended for persons subject to sanctions or located in OFAC-restricted countries.

3. Account & security

You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately at support@optionsdeck.ai if you suspect unauthorized access. You may not share your account or resell access.

4. Subscriptions, billing, and refunds

OptionsDeck offers free trial, Pro ($149/month), and Elite ($399/month) tiers. Subscriptions auto-renew monthly until cancelled. You may cancel at any time from /account (which links into the Stripe-hosted billing portal). Cancellation takes effect at the end of the current billing period.

30-day money-back guarantee. If you cancel within 30 days of your first paid charge, contact support@optionsdeck.ai and we will refund that charge in full. After the 30-day window, we offer pro-rated refunds of the unused portion of the current cycle at our discretion.

Failure to pay (chargeback, expired card, declined transaction) will result in account suspension. Recurring chargebacks may result in permanent account termination.

5. Acceptable use

You agree NOT to:

• Reverse-engineer, decompile, or attempt to extract the source code of the Service
• Scrape, mirror, or republish OptionsDeck data or AI outputs
• Use the Service to violate any applicable law or regulation, including securities laws
• Resell, sublicense, or commercialize Service access without our written permission
• Attempt to gain unauthorized access to any system, account, or data
• Interfere with the operation of the Service or use it to attack other systems
• Use the Service to provide investment advice to third parties (you may use it for your own trading)

6. Intellectual property

OptionsDeck Terminal, its UI, source code, AI prompts, dealer-positioning models, brand assets, and all associated intellectual property are owned by OptionsDeck Terminal LLC and protected by copyright and other laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal trading during your active subscription. All rights not expressly granted are reserved.

Trade ideas you generate via OptionsDeck AI Strategist are yours to trade on, share, or save. Aggregated, anonymized usage data (which strategies are popular, which tickers see the most ideas, etc.) may be used by us to improve the Service.

7. Third-party services

OptionsDeck relies on third-party providers for payment processing (Stripe), email delivery, market data (delivered as the OptionsDeck Direct Feed), and AI reasoning (delivered as OptionsDeck Core). A current list of our sub-processors is maintained on our Sub-processors page. Use of these third parties is governed by their respective terms. We are not responsible for outages, errors, or actions of third-party providers.

8. Termination

We may suspend or terminate your account at any time for breach of these Terms, for suspected fraud, or for any conduct we deem harmful to the Service or other users. You may terminate by cancelling your subscription and emailing support@optionsdeck.ai to delete your account. We will delete personal data within 30 days of account deletion request, subject to legal retention requirements.

See the full Legal Disclaimer. The Service is provided "as is" without warranty of any kind. We make no representations about the accuracy, reliability, or completeness of any market data, AI output, or analytics on the Service.

10. Limitation of liability

To the maximum extent permitted by law, OptionsDeck's total aggregate liability for any direct damages is limited to the amount you paid us in the 12 months preceding the claim. We are not liable for any indirect, incidental, consequential, special, or punitive damages — including trading losses, lost profits, or lost opportunities.

11. Indemnification

You agree to indemnify and hold harmless OptionsDeck Terminal LLC, its officers, employees, and affiliates from any claim, damage, loss, or expense (including reasonable legal fees) arising from your use of the Service, your trading activity, or your breach of these Terms.

12. Governing law & disputes

These Terms are governed by the laws of the State of Delaware (USA), without regard to conflict-of-law principles. Any dispute will be resolved exclusively in the state or federal courts located in Delaware. You waive any objection to venue or jurisdiction in those courts.

13. Changes to these Terms

We may update these Terms periodically. Material changes will be announced via email and the "Last updated" date will be revised. Continued use after notice constitutes acceptance.
